These Terms and Conditions (“Agreement”) govern your access to and use of our website and all related services, tools, and applications (collectively, the “Services” or “AI System”). By accessing or using nudivaapp.com, you agree to be bound by this Agreement. If you do not agree, you must not use the Website or Services.

2. Services

Purpose and Use. nudivaapp.com provides AI-based image processing tools that allow you to upload images and generate visual outputs for private, personal, and non-commercial use only.
Jurisdictional Restrictions. Our Services are not available where their use would violate applicable laws or regulations. See Schedule 1 for restricted countries.
User Responsibility. You are solely responsible for ensuring that your use of the Services complies with applicable laws and these Terms, and for all content you upload, modify, or generate.
Prohibited Sharing. Generated images are intended for personal use only. Downloading, sharing, publishing, or distributing generated content outside the platform without authorization may result in suspension, termination, and/or legal action.
Access Levels. Some features may be available without registration. Creating an account may unlock paid features, credit packages, and/or subscription plans as described on the Website.
Eligibility. You must be at least 18 years old and have full legal capacity under the laws of your jurisdiction. Do not upload images of others without their explicit consent. Any illegal, misleading, or non-consensual use is strictly prohibited.

3. Data Privacy and Session Processing

User uploads and prompts (“Input Data”) are processed on a session-based basis, primarily within your active browser session where technically feasible. nudivaapp.com does not permanently store user images by default. Input Data is automatically deleted when your session ends. No data is retained, shared, or used for AI training without your explicit consent. 4. Service Modifications

We may modify, update, suspend, or discontinue the Website or any part of the Services at any time, with or without notice. New or updated features are governed by these Terms unless otherwise stated.

5. Prohibited Use

You must not upload, generate, or attempt to generate content that:

Depicts minors under the age of 18 or involves non-consensual acts;
Violates intellectual property, privacy, or publicity rights, or uses another person’s likeness without permission;
Promotes, incites, or depicts violence, terrorism, harassment, exploitation, or discrimination;
Attempts to bypass safeguards, filters, or access controls, or engages in illegal activity;
Spreads spam, malware, or engages in hacking, abuse, or security attacks.

Violations may result in immediate content blocking, account suspension or termination, and reporting to authorities where required by law.

6. AI Fairness and Transparency

We design and evaluate our AI systems to support fairness, inclusivity, and compliance with applicable laws. While we work to minimize harmful or biased outputs, results may vary. Users are encouraged to report problematic outputs via the Contact section.

7. Training Data Disclosure

AI models used on nudivaapp.com are trained using synthetic, licensed, and/or ethically sourced datasets. User-generated content is not used to train or retrain AI models without explicit, informed consent.

8. Content Moderation

Automated and manual moderation tools may be used to detect and prevent illegal or prohibited content. Uploading or attempting to generate content involving minors, public figures, or non-consensual imagery is strictly prohibited and may result in immediate enforcement action.

Our Services are not intended for children’s images. Content involving minors is blocked and not retained, except where required by law for reporting purposes.

10. Monitoring and Compliance

We may monitor usage and activity to ensure compliance with these Terms. Enforcement actions may include warnings, content removal, feature limitations, temporary suspensions, or permanent termination. Serious violations may be reported to law enforcement.

11. Payments

Registered users may purchase credits or subscription plans to access premium features. Prices and billing terms are displayed at checkout and may change from time to time. You are responsible for providing accurate payment information and for any applicable taxes or fees.

12. Refund Policy

Refund requests may be submitted within 14 calendar days of purchase. Approved refunds are issued to the original payment method within a reasonable processing period. Partial or no refunds may apply if Services or credits have already been used, as disclosed at purchase.

Access to nudivaapp.com is restricted or unavailable in the following countries and territories, and in any region subject to comprehensive international sanctions: Afghanistan, Belarus, China, Cuba, Iran, Iraq, North Korea, Russia, Syria, Sudan, Venezuela, Yemen, Zimbabwe.

Schedule 2 – Addendum for Australian Users

Australian users must comply with applicable Australian online safety and content regulations.
Prohibited content includes Class 1A and Class 1B material under Australian law.
Misuse of the Services may result in suspension, termination, and reporting to relevant authorities.
Safety notices may appear when attempts are made to generate restricted content.
